These Terms of Service ("Terms," "Agreement") govern your access to and use of the website https://rgvps.top and all related services, including but not limited to Virtual Private Server (VPS) hosting, cloud infrastructure, and associated support (collectively, the "Service").

This Agreement is a legally binding contract between you ("User," "you," "your") and rgvps.top ("Company," "we," "us," "our"), located at 1016 Park Blvd, Covington, Kentucky 16595.

By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions contained herein. If you do not agree to all these terms, you are expressly prohibited from using the Service and must discontinue use immediately.

1. Acceptance of Terms

By creating an account, placing an order, or utilizing any Service provided by rgvps.top, you affirm that you are at least 18 years of age, or the age of majority in your jurisdiction, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes by posting the new Terms on our website and updating the "Effective Date." Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.

2. Use of Service

rgvps.top provides virtual private server hosting and related cloud infrastructure services. The specific features, specifications, and pricing of your service are detailed in your service order ("Order") and are incorporated into this Agreement by reference.

2.2 Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2.3 Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted, secure, or error-free operation. The Service is subject to scheduled and unscheduled maintenance. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

2.4 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with this Agreement and all applicable local, state, national, and international laws and regulations. You are solely responsible for all content, data, and activities conducted through your Service instance.

3. User Responsibilities

3.1 Prohibited Activities

You expressly agree not to use the Service to:

• Engage in, promote, or facilitate any illegal activities, including but not limited to fraud, money laundering, or the distribution of illegal substances.
• Host, distribute, or link to malicious content, including malware, viruses, Trojan horses, or other code that may damage, interfere with, or unlawfully intercept systems, data, or personal information.
• Infringe upon the intellectual property rights, privacy rights, or other rights of any third party.
• Send unsolicited commercial email ("spam") or engage in any form of abusive electronic communication, including phishing, denial-of-service attacks, or network abuse.
• Host or distribute content that is excessively violent, harassing, defamatory, obscene, or otherwise objectionable.
• Operate services that place an unreasonable burden on our infrastructure, as determined solely by us, including but not limited to cryptocurrency mining (unless explicitly permitted by your plan), unauthorized resource reselling, or running public IRC servers/bots.
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or any other systems or networks connected to the Service.

3.2 Security and Backups

You are solely responsible for maintaining the security of your server instance, including applying security patches, configuring firewalls, and managing user access. You are also solely responsible for maintaining regular backups of your data, applications, and configurations. rgvps.top is not liable for any data loss or corruption under any circumstances.

3.3 Payment and Billing

You agree to pay all fees specified in your Order. Fees are billed in advance on a recurring basis (monthly, quarterly, annually) unless otherwise agreed. Failure to pay fees by the due date may result in immediate suspension or termination of your Service. All fees are non-refundable except as required by law or at our sole discretion.

4. Intellectual Property

All rights, title, and interest in and to the Service, including our website, underlying software, technology, and all content provided by us (excluding your User Content), are and will remain the exclusive property of rgvps.top and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights to the content, data, and applications you upload, store, or process using the Service ("User Content"). By using the Service, you grant rgvps.top a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and transmit your User Content solely to the extent necessary to provide and maintain the Service for you.

The trademarks, logos, and service marks displayed on our website are our property or the property of other third parties. You are not permitted to use these marks without our prior written consent or the consent of the third party that owns the mark.

5. Limitation of Liability

5.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RGVPS.TOP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RGVPS.TOP, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE
